Opinion: Legislation gives government unprecedented power to order prolonged arbitrary imprisonment of refugees, including their children


With reports that Canada incarcerated 289 migrant children in detention facilities last year, Canada’s increasingly questionable policy of detaining refugee claimants, including children, is again in the spotlight.
In response to media comments that refugee children languish in detention, Minister of Public Safety Vic Toews and Minister of Citizenship, Immigration and Multiculturalism Jason Kenney explain that the practice of detaining refugee claimants and refused claimants is not new in Canada.

There have been four damning indictments of the Irish asylum system in as many months.
The first was a report by the Irish Refugee Council on the lives of asylum-seeking children in direct provision.  Direct provision is the system of accommodation and subsistence provided to asylum seekers.  Owing to delays in the asylum process, asylum seekers can live in direct provision for many years, or an entire childhood in the case of some children.

The High Court has ruled that the failure to consider the continued detention of a mentally ill failed asylum seeker in accordance with immigration policy rendered his detention unlawful in part.
The Claimant applied for asylum based upon his account of an attack during the Rwandan genocide and subsequent events.  The Home Secretary refused the application and the Claimant appealed.  At the appeal he was unrepresented and he adduced no medical evidence.  The Immigration Judge dismissed his appeal, disbelieving the entirety of his account. Once his appeal rights had been exhausted (that is, he was unable to appeal any further through the courts), the Secretary of State detained him on 19 October 2010 for the purpose of removal.
