On 15 June 2017, the Administrative Tribunal of Nice ruled on a référé-liberté case brought by different French NGOs, such as ANAFE, CIMADE and GISTI, regarding the practice of detention at the French-Italian border. The organisations asked for the suspension of the informal decision by the Alpes-Maritimes authorities to create a provisional detention zone in the city of Menton, for the release of all of those detained at that zone and for the placement of unaccompanied minors in appropriate reception centres.

The Court ruled that the information put before it, particularly with regard to the duration of the detention, was not sufficiently certain and precise. Therefore, it could not suspend the informal decision to create a provisional detention zone altogether. However, it affirmed that those who have been detained at the police station in Menton for more than four hours had to be transferred to official transit zones. It concluded that ordering the placement of unaccompanied minors was not within the mandate of the référé judge.

With human migration reaching unprecedented levels, many States are struggling to respond to new refugee, asylum-seeker and migrant arrivals.
Current crises highlight the need for alternative approaches that respect fundamental right to liberty, security, and human dignity, while still ensuring that States can responsibly govern their borders.
Over the past five years, the IDC has undertaken a program of research to identify and describe a number of positive alternatives to immigration detention (‘alternatives’) that respect fundamental rights, are less expensive and are equally or more effective than traditional border controls. The IDC has identified over 250 examples of alternatives from 60 countries.
This research, entitled There are alternatives, provides readers with the guidance needed to successfully avoid unnecessary detention and to ensure community options are as effective as possible.
The research was launched during the 30th Session of the UN Human Rights Council in Geneva  co-hosted by the Office of the High Commission for Human Rights and the the Permanent Mission of Sweden.

Thousands of migrants detained in Greece for lacking the correct paperwork, including some asylum seekers and teenagers, are held in often appalling conditions without access to basic hygiene and regular medical care, according to a medical aid group which accused the Greek state of causing "unnecessary suffering and harm."

In a report released Tuesday, Medecins Sans Frontieres, or Doctors Without Borders, expressed "grave concerns" and urged Greece to "put an end to the systematic and indiscriminate use of detention" for migrants found in the country without the correct documentation — many often picked up during random checks after living in Greece for years.

The Australian Human Rights Commission is conducting an inquiry into Australia's practice of placing asylum seeker children in detention. Following a visit to Christmas Island's detention facilities in March, the president of the Human Rights Commission, Gillian Triggs, said Australia was in breach of international law.
"As a matter of very clear international law children should not be detained for anything more than what is absolutely necessary for health checks and security checks," Professor Triggs told ABC News 24.
